Minnesota is an employment "at will" state. An employee can quit for any reason; an employer can fire any employee for any reason as long as that reason is not illegal, such as discrimination based on race, creed, color, sex, national origin, ancestry, religion, age, disability, sexual orientation or marital status. Notice of separation No notice of separation is required by law, by either party, upon separation of an employee for any reason. Courtesy and time to collect accrued benefits are reasons why notice is given.

How many hours do I have to work to be considered a full-time employee? Minnesota law does not define employees as full or part time, rather Minnesota Rules 5200.0170 defines a workweek. A workweek is a fixed and regularly recurring period of 168 hours, seven consecutive 24-hour periods.

How do I get my final paycheck? I was laid-off, fired or my job ended  You must make a written demand to your employer for all wages. See our sample letter. The employer must pay all final wages within 24 hours of receiving the written demand. If you handled money or property for your employer, your employer may take 10 calendar-days to audit its records before issuing your final paycheck.

Paying overtime – Minnesota law The Minnesota Fair Labor Standards Act requires employers to pay overtime for all hours worked in excess of 48 per workweek, unless the employee is specifically exempt under Minnesota Statutes 177.23, subdivision 7. Overtime pay must be at least one-and-one-half times the employee's regular rate of pay. This is calculated by dividing the total pay in any work week by the total number of hours worked in that week.

Required statement of earnings Employers are required to provide each employee with a written statement of earnings.
