Minnesota Rules Part 5221.6050 Subp. 9 requires health care providers to give the insurer notification before proceeding with certain types of treatment. Prior notification applies to certain chronic management modalities, some types of durable medical equipment and non-emergency inpatient hospitalization and treatment that departs from a parameter. The rules also specify your obligation to respond to the health care provider's prior notification. In most cases, the provider can provide the treatment even if the insurer disagrees, subject to a determination by the department or a compensation judge about whether the treatment was reasonable.
