Situation #1:

The entire window unit is removed and a new window unit is installed.

Answer:

Compliance with U.B.C. Sec. 310.4 is required.

Situation #2:

A building is moved into or within the jurisdiction. The sleeping rooms do not comply with Sec. 310.4.

Answer #2:

(Same as answer #1) UBC Sec. 3404 requires that "buildings or structures moved into or within the jurisdiction shall comply with the provisions of this code for new buildings or structures."

Division comments:

Division Comments: UBC Section 104.2.7 permits modifications in code enforcement where there are "practical difficulties." This may be considered in both situations particularly if the house was built under a previous code that may have allowed a 48 inch sill height or 5.0 square feet in openable area.
